Terms of Service

These Terms of Service ("Terms") govern your access to and use of Werx Takeoff (the "Service"), operated by WerxOS ("WerxOS", "we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

Werx Takeoff is a cloud application for earthwork and sitework quantity takeoffs — uploading plan sets, calibrating scale, measuring, computing cut & fill, and exporting takeoff summaries. We may add, change, or remove features over time.

2. Accounts

You are responsible for the activity under your account and for keeping your credentials secure. You must provide accurate information and be at least 18 years old. Authentication is provided through our identity provider.

3. Subscriptions & billing

Paid plans are billed in advance on a monthly ($149.99/mo) or annual ($1,200/yr) basis through our payment processor (Stripe). Subscriptions renew automatically until cancelled. You can manage or cancel your subscription from Settings → Billing. Fees are non-refundable except where required by law.

4. Your content

You retain all rights to the plans, drawings, measurements, and data you upload or create ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to provide the Service. We do not claim ownership of Your Content and do not sell it.

5. Acceptable use

You agree not to misuse the Service: no unlawful use, reverse engineering, attempts to breach security or another tenant's data, or uploading malicious files. We may suspend accounts that violate these Terms.

6. Estimates & professional judgment

Quantities, cut/fill volumes, and exports produced by the Service are estimates derived from your tracing and calibration. They are tools to assist a qualified estimator and are not a substitute for professional judgment or engineered surveys. You are responsible for verifying quantities before relying on them for bidding or construction.

7. AI features

AI-assisted detection and tracing produce suggestions that you review and confirm. They are not guaranteed to be complete or accurate and must be verified before use.

8. Availability & warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, WerxOS will not be liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid for the Service in the 12 months before the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms. On termination, your right to use the Service ends; you may export Your Content beforehand.
